Use of the site, the tools, and the Upside+ subscription.

1. What this site is

The Upside Index publishes football analysis: fantasy football projections and rankings, waiver and survivor tools, and an NFL Draft prospect board and mock draft simulator. Everything it produces is a model output and an opinion. It is informational, it changes as the underlying data changes, and it is not a guarantee of any outcome.

Accuracy is published at /methodology, including the criteria the model does not currently meet. Please read it before relying on a number from this site.

Nothing here is betting advice, investment advice, or professional advice of any kind. You are responsible for your own decisions, including any wager you place.

4.1 Price and term

Upside+ costs $4.99 per month or $39.99 per year, in US dollars, excluding any tax that applies where you are. You choose the term at checkout.

4.2 Automatic renewal

Your subscription renews automatically. At the end of each billing period we charge the payment method on file for another period of the same length at the then-current price, and we keep doing that until you cancel. A monthly subscription renews every month on the day of the month you subscribed; an annual subscription renews every year on that date.

4.3 Trial

If a free trial is offered, its length is stated at checkout. A trial converts into a paid subscription automatically when it ends unless you cancel before then. You can cancel during a trial at no cost.

4.4 Payment processing

Payments are processed by Stripe. We do not receive or store your full card number. Stripe's handling of your payment data is governed by Stripe's own terms and privacy policy.

4.5 Failed payments

If a charge fails we may retry it and will email you. Access continues during the retry window and is suspended if payment is not completed. A suspended subscription can be reactivated by updating the payment method.

5. Cancellation

You can cancel at any time, from your profile page, in the same number of steps it took to subscribe. No phone call, no email, no retention offer you have to decline.

8. Changes to the service

The product changes. Features are added, and occasionally a feature is removed because the evidence for it did not hold up. If we remove something material from a paid tier during a period you have paid for, you may cancel and ask for a pro-rata refund of the remainder.

We aim to keep the site available but do not promise uninterrupted service. Data feeds we depend on can fail, and when they do we would rather show you that a number is stale than invent one.

The site and its outputs are provided “as is” and “as available”, without warranties of any kind, to the fullest extent the law allows. We do not warrant that any projection, ranking or recommendation will be accurate or profitable.

To the fullest extent the law allows, our total liability to you for any claim relating to the site or a subscription is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, and (b) $50. We are not liable for indirect, incidental, special or consequential loss, including lost winnings, lost profits, or the outcome of any wager or league.

Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

11. Privacy

How we handle your data is set out at /privacy. In short: we collect what an account needs to work, we use aggregate analytics to see which pages are used, and we do not sell personal data.

12. Changes to these terms

We may update these terms. For a material change affecting a paid subscription we will email subscribers at least 30 days before it takes effect, and you may cancel before then if you do not accept it. The date at the top of this page shows when it last changed.

13. Governing law and disputes

These terms are governed by the laws of the State of Nevada, United States, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Clark County, Nevada, and you and we consent to the jurisdiction of those courts.

If you are a consumer resident elsewhere, this clause does not remove any right you have to bring proceedings in your own country of residence where the law gives you that right.

This clause in particular is one a lawyer should review: the governing-law and venue choice needs to match where the business is actually established, and that has not been confirmed.
